How much notice to terminate tenancy and file eviction

Florida Statute § 83.57 requires a landlord to give a month to month tenant 15 days notice before the end of a monthly rental period so that the tenant can make arrangements to move somewhere else. HOWEVER, tenants in Miami-Dade county have longer notice periods due to an ordinance passed by the county in March 2022. The ordinance requires that a termination notice or any rent increase greater than five percent must be notified to tenant at least 60 days before the end of a monthly rental period. This ordinance comes after an earlier ordinance that only increased the notice period to 30 days.

While landlords with property(ies) in Miami-Dade may not be too happy about the new requirement, tenant must still of course pay the monthly rent while the 60 day notice period expires. And, to be fair to the tenant, the real estate rental market right now in Miami has skyrocketed to a historical point that leaves tenants in a difficult position to move out quickly.
